The petitioner by this writ petition has claimed appointment on compassionate ground being ward of Shri Ram Krishan Singhal, an employee of
Sriganganagar Sugar Mills Ltd. Sriganganagar who died on 13/10/1970 while in service. The writ petition claiming appointment was filed in the month of
September, 1993. The appointments on compassionate grounds can be given while the person is in harness.
No such appointment can be provided at a belated stage. It is further pertinent to note that the respondent company resolved for making appointment on compassionate grounds on 12.06.1989 and the same is a decision perspective in nature. Prior to it there was no provision for making such type of appointments. In view of it, no right of the petitioner is infringed.
In view of it, the writ petition stands dismissed. [Govind Mathur],J.
