D.B. CR. 3rd Bail Application NO.442/2006 in
D.B. Criminal Appeal No.202/2003
Bhanwarlal & Bhanwaria @ Dundhia Vs. State of Raj.
HON'BLE MR.JUSTICE RAJESH BALIA
HON'BLE MR. JUSTICE R.P. VYAS
Mr. Ranjeet Joshi for the applicant.
Mr. S.N. Tiwari, Public Prosecutor. _____
Heard learned counsel for the applicant Bhanwarlal @
Bhanwaria @ Dundhia. The first bail application preferred by the applicant was not pressed on 15.12.2003 while pressing the bail applications for the other co-accused by distinguishing the case of the applicant from the case of other co-accused. Thereafter on 22.11.2005 second bail application was rejected finding no change in the circumstances. The third bail application has been moved within 6 months from the rejection of second bail application.
Having considered the third bail application, we see no change in the circumstances to suspend the sentence of the applicant.
The application is, therefore, rejected. [ R.P. VYAS ], J. [ RAJESH BALIA ], J. babulal/
