RAJESH v SUNITA - CMA Case No. 753 of 2003 [2006] RD-RJ 1111 (15 May 2006)

S.B. CIVIL MISC. APPEAL NO. 753/2003

Date : 15.05.2006

HON'BLE MR. BHAGWATI PRASAD, J.

Mr. Usman Ghani for the appellant.

Mr. Vinay Shrivastava for the respondent. == = =

Heard.

The appellant is absent. The respondent is present. It has been revealed that the appellant has taken another woman in his fold. Still, the respondent wife says that she is prepared to accomodate her husband but his absence shows that he is not prepared to reconcile. Therefore, attempts of reconciliation ends in futility. His absence on the appointed date fortified this inference. The case will be now heard on merits.

Put up on 23.05.2006

(BHAGWATI PRASAD), J. bjsh
