MANGILAL LUHAR v BHANWAR LAL - CFA Case No. 50 of 1994 [2006] RD-RJ 1130 (16 May 2006)

S.B.CIVIL FIRST APPEAL NO.50/1994

(Mangi Lal Vs. Bhanwarlal & Ors.)

Date of order :: 16.05.2006

HON'BLE MR. JUSTICE KRISHAN KUMAR ACHARYA

None present for the appellant.

Mr.K.C.Samdaria, for the respondent.

There is no appearance on behalf of the appellant. Having perused the earlier order-sheets, I find that on 18.4.2006, Mr.Ghanshyam Vaishnave, learned counsel sought time to file 'Vakalatnama' on behalf of the appellant but power has not yet been filed.

Looking to all the facts and circumstances of the case, since no one appears on behalf of the appellant despite giving sufficient opportunity, the present appeal is dismissed in default for want of prosecution.

(KRISHAN KUMAR ACHARYA), J.
