VIVEK SONI v R P S C AJMER & ANR - CW Case No. 386 of 2006 [2006] RD-RJ 1143 (16 May 2006)

S.B. Civil Writ Petition No.386/06

Vivek Soni Vs. RPSC & Anr.

Date of Order : 16/05/2006

Hon'ble Mr. Justice Ajay Rastogi

Mr. Mahendra Tiwari, for petitioner

Instant petition has been filed seeking direction for re-evaluation of answer-sheets with regard to his participation in RAS Main Examination 2003. According to his own assessment, he was expecting better marks than what has been awarded by the Commission while declaring result of RAS Main Examination.

On the question put to the counsel as to whether there is any provision for re-evaluation of the answer- sheets under rules, he candidly accepts that no such provision has been made available and there is also no such provision came to his notice where re-evaluation is provided under the relevant rules.

In my opinion, in the absence of any statutory provision available for re-evaluation, the petitioner is not entitled for re-evaluation of his answer-sheets.

Consequently, the writ petition fails and is hereby dismissed. [Ajay Rastogi],J.
