RAM KARAN LORA v STATE OF RAJASTHAN - CW Case No. 3056 of 2006 [2006] RD-RJ 1160 (17 May 2006)

S.B. Civil Writ Petition No.3056/06

Ram Karan Lora Vs. State & Anr.

Date of Order : 17/05/2006

Hon'ble Mr. Justice Ajay Rastogi

Mr. Manish Bhandari, for petitioner

Advertisement was issued from the office of respondents on 14th June, 2005 inviting applications for the post of Constable [Ghudsawar] along with other posts identified on district-wise basis.

Petitioner also participated in the process of selection for the post of Constable [Ghudsawar] for

District Karauli. In pursuant to advertisement Ann.1 he qualified written examination and so also efficiency test. Necessary documents have been placed on record.

Petitioner has raised grievance about condition of advertisement No.15.4 that few of the candidates was afforded second opportunity which is violative of condition referred to and which has jeopardized his fair right of consideration and he has further made grievance that the selection process which was initiated for

District Karauli was not fair and not in consonance with

Article 14 of the Constitution and to this effect he has made representation to the authority, copy of which has been placed on record as Ann.4 dt.23rd March, 2006.

Shri Manish Bhandari, counsel for petitioner submits that he has specifically pointed out his grievance with regard to errors committed in the process adopted by the authority at District Karauli in making selection for the post of Constable [Ghudsawar], but despite request made the authority has failed to consider his grievance.

Without expressing any opinion on merits of the matter, in my opinion, the petitioner may submit a fresh representation before the authority within a period of 10 days pointing out his grievance in respect of selection process initiated for the post of Constable [Ghudsawar] for District Karauli in reference to th advertisement Ann.1 dt.14 June, 2005 and the concerned competent authority after affording opportunity to the petitioner may decide the same by speaking order in accordance with law within one month thereafter.

With the above directions, the writ petition stands disposed of. [Ajay Rastogi],J.
