Heard learned counsel for the parties on the application for suspension of sentence and perused the judgments of the trial court as well as of appellate court so also the record.
Learned counsel for the petitioner submits that the petitioner is prepared to pay part of compensation amount i.e. a sum of Rs.10,000/- if released on bail.
Having considered the totality of facts and circumstances of the case, I think it just and proper to suspend the sentence awarded to the accused petitioner.
Accordingly, the bail application filed under Sec. 397/401
Cr.P.C. is allowed and it is ordered that the sentence passed by the learned trial court and affirmed by the Sessions Judge, SriGanganagar in criminal appeal No. 108/2005 against the petitioner Baldev s/o Puran Chand shall remain suspended till final disposal of the aforesaid revision petition provided the petitioner deposits part of compensation i.e. a sum of
Rs.10,000/- before the trial court and also executes a personal bond in the sum of Rs. 20,000/- with two sureties of Rs.10,000/- each to the satisfaction of the learned trial Judge for his appearance before this court on 04.08.2006 and whenever ordered to do so with the incorporation in the bond that as and when he will shift his place of residence, he will intimate to this Court and his lawyer about his new place of residence.
