Instant petition has been filed seeking direction to make appointment in terms of policy of reservation providing 16% to the members of SC to be filled in pursuant to advertisement Ann.1 dt.2nd June, 2004.

Petitioners herein are members of Scheduled Caste category and appeared in pursuant to advertisement nd issued by the RPSC dt.2 June, 2004 whereby selections were made by holding Primary and Upper Primary School

Teachers Competitive Examination, 2004. All the petitioners appeared and participated in the process of selection, but their names at present do not find place in the select list published by RPSC.

Counsel for petitioner contends that vacancies, which were actually filled in pursuant to advertisement

Ann.1, are not in accordance with reservation policy providing 16% overall vacancies to be filled by the members of SC and if vacancies would have been filled in accordance with policy of reservation, the petitioners might have fallen in the select list to be considered for appointment against reserved quota and in this regard representation was made vide Ann.4 to the State

Government, but no satisfactory explanation has come forward.

Before going into merits of the matter, I consider it proper to direct the petitioners to make fresh representation within a period of one month pointing out grievance before the competent authority who will consider and decide the same while passing speaking order in accordance with law within a period of two months thereafter. Copy of the same be also supplied to the petitioners.
