By an application under Section 389 Cr.P.C., applicant-appellant Darshan Singh S/o Labh Sing seeks temporary suspension of sentence on the ground that the marriage of his sister is going to be solemnized on 12-6-2006.
He has placed on record Marriage Card of Bibi Gurjit Kaur marrying to Kaka Gurdeep Singh on 12-6-2006 and a certificate to this effect issued by the Sarpanch, Gram Panchayat, Nirwana.
Having regard to the facts and circumstances of the case, I think it just and proper to temporarily suspend the sentence of imprisonment awarded to the appellant from 05-6- 2006 to 20-6-2006.
Accordingly, the bail application filed under Section 389 Cr.P.C. is partly allowed and it is ordered that the sentence passed by the learned Additional Sessions Judge (Fast Track),
Anoopgarh, vide judgment dated 14-8-2002 in Sessions Case
No.11/2001 against appellant-applicant Darshan Singh S/o Labh
Singh shall remain temporarily suspended from 05-6-2006 to 20-6-2006 and direct that the appellant-applicant be released on bail for the period from 05-6-2006 to 20-6-2006, provided he executes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Court for his surrender before the trial Court on 21-6-2006 and to undergo the sentence awarded.
