Heard learned counsel for the petitioner.
After going through the facts of the case and the detailed reasons given by the trial court, I do not find any reason to interfere in the order passed by the trial court on 20.5.2006 as the court below has not committed any error of jurisdiction or even error of law by rejecting the application filed by the petitioners under Order 7 Rule 11
CPC and furthermore because of the reason that the defendants have been given liberty to raise the objection in the written statement so that the issue raised by the defendants may be decided properly after framing the issues and at the time of decision of the suit.
Consequently, I do not find any merit in the revision petition and the same is hereby dismissed.
