Prosecutor for the State.

It appears that the prosecution has already concluded its evidence and the matter reached to the final stage. In the circumstances, therefore, it is not appropriate to appreciate the evidence at this stage, on the contrary, it is for the trial court to appreciate the evidence and decide the matter.

The bail application filed by petitioner under section 439

Cr.P.C. is accordingly dismissed. The trial court shall dispose of the matter utmost expeditiously.
