OMA RAM v STATE - CRLMB Case No. 1938 of 2006 [2006] RD-RJ 1583 (13 July 2006)

S.B.CR MISC. BAIL APPLICATION NO.1938/2006

Date : 13.07.2006

HON'BLE MR. SATYA PRAKASH PATHAK,J.

Mr. J.S. Choudhary for the applicant.

Mr. V.R. Mehta, Public Prosecutor for State.

Mr. Dixit Bohra for the complainant.

Learned counsel for the applicant submits that he does not want to press the instant bail application. However, he submits that he may be permitted to move regular bail application after material witnesses are examined.

In view of the statement made by learned counsel for the applicant, I deem it proper to pass following order :

The learned trial court shall record in preference statements of material witnesses in this case and thereafter if any bail application is moved by the applicant, then, the same will be considered in accordance with law. The learned trial court may also expedite trial.

With above observation, the bail application stands dismissed as not pressed.

(SATYA PRAKASH PATHAK), J.
