The case was called twice on 24.7.2006 and 25.7.2006, but none appeared on behalf of the petitioner. Today also, none present on behalf of the petitioner.
I have gone through the record of the writ petition and heard counsel for the respondents.
By this writ petition, the petitioner has challenged the judgment of the Rajasthan Civil Services Appellate Tribunal dated 19.5.1993 whereby the appeal filed by the petitioner for claiming promotion to the post of LDC from the post of Class-IV has been rejected on the ground that in the seniority list as well as in the eligibility list, the alleged junior Girija
Shanker is senior to the petitioner (appellant), therefore, the said appeal was rejected having no merit.
Here in the instant writ petition also, the petitioner has challenged the eligibility list and further sought correction in the seniority list. The respondents have submitted that seniority list as well as consequential eligibility list has been prepared as per Rule 19 of the Rajasthan Class-IV
Service (Recruitment and other Service Conditions) Rules, 1963 and the date of joining had nothing to do with the seniority.
Therefore, there is no substance in the contention of the petitioner to entertain the dispute of seniority at this belated stage. Otherwise also, list has been prepared as per Rule 19 of the Rules of 1963. There is no substance in the writ petition and the same is dismissed.
