By the instant writ petition, the petitioner has claimed deputation / duty salary orders fro the study period 14.9.1984 to 13.9.1986 spent by him for M.D. Course. The petitioner has also claimed other service benefits.
The submission of counsel for the petitioner is that the instant case is squarely covered by the order dated 31.3.1990 of Division
Bench in DB civil writ petition No.2230/1986 Dr.C.R. Agarwal &
Ors. V/s The State of Rajasthan, which is as follows:-
"This writ petition is squarely covered by the decision of this Court in D.B.C.
Writ Pet. No.72/83 Dr.P.M. Bhandari Vs.
State of Raj. Decided on August 1, 1988. A direction was also given in that writ petition to give similar treatment to the petitioners and other persons who are similarly situated so that they may not be driven to file fresh writ petitions and unnecessarily increase litigation. By this observation even otherwise the respondents were under an obligation to give similar treatment to the petitioner. The respondents are, therefore, directed to observe the directions given in the aforesaid writ petition.
The writ petition is disposed of accordingly with no order as to costs."
Counsel for the respondents does not dispute the above mentioned position.
The writ petition is disposed of in the terms indicated in the order dated 31.3.1990 of Division Bench in DB civil writ petition
No.2230/1986 Dr.C.R. Agarwal & Ors. V/s The State of Rajasthan.
