This writ petition has been filed against the judgment of the learned Board of Revenue whereby while accepting the second appeal by the impugned judgment dated 30.06.1997, learned Board of Revenue remanded the case to the learned trial court.
Learned counsel for the respondents has submitted that after remand, the learned trial court decreed the suit in favour of the petitioner on 13.03.2000 and against the aforesaid decree, the respondents preferred an appeal before the learned
Revenue Appellate Authority which was allowed on 12.07.2001 and the matter was again remanded by the learned Revenue Appellate Authority to the learned trial court. It is submitted that after the order of remand by the learned Revenue Appellate Authority, the learned
-:2:- trial court has again decreed the suit on 04.02.2003.
In view of the above, since the directions contained in the judgment of learned Board of Revenue have already been implemented, I am of the view that this writ petition has become infructuous.
Consequently, the writ petition as well as the stay application are dismissed as having become infructuous.
