The case of the petitioners is that the petitioners who are Ex-
Servicemen having served Indian Army in the Army Medical Corps are qualified in General Nursing and want to work as Medical Practitioners on the basis of the qualifications and certificates attained by them.
They have, therefore, prayed that a writ may be issued directing the respondents not to interfere in their working and functioning as Medical
Practitioners on the basis of their qualifications.
Notices were issued to the respondents and reply has been filed on behalf of the respondents in which it has been stated that to permit a person to practice as a Medical Practitioner, depending upon the qualifications, the concerned person has to be enrolled on the rolls of
Medical Council under Indian Medical Council Act, 1956 and for Nursing
Staff under the concerned Act relating to General Nursing.
In view of the above, it is hereby directed that in case, the petitioners apply for their enrollment as Medical Practitioners or for the purposes of General Nursing, their applications supported by the relevant documents pertaining to their qualifications and experience, shall be considered by the concerned authority and the applications, so submitted, shall be decided in accordance with law. The applications, so submitted, be decided within within a period of three months of the receipt of the same.
This writ petition accordingly stands disposed of, as above.
The stay application also stands disposed of.
