The instant revision petition under Section 397 read with 401 Cr.P.C. is directed against the order dated 8.8.2006 passed by the learned Addl.
Sessions Judge, Kotputli in Sessions Case No.17/2005 framing charge for the offence under Section 316 IPC against the petitioner.
Learned counsel for the petitioner has contended that as per the report of the medical officer, no injury has been found on the abdominal region of Suman and he has also opined that abortion and death of the unborn child had not taken place due to any injury, therefore, the petitioner should be discharged of the offence under Section 316 IPC.
Learned PP has supported the impugned order.
I have carefully considered the submissions made at the bar and have also perused the impugned order as well as the relevant record placed before me for perusal.
In view of the materials on record, no case for interference in the impugned order is made out as there is neither any error, nor illegality nor impropriety in the said order. This apart, the order impugned is well reasoned and well considered. I therefore, find no case for admission of this revision petition and the same is dismissed.
