Learned counsel for the petitioner, in the facts and circumstances of the present case has relied upon a decision of the Division Bench of this court in D.B.Special Appeal (Writ) No.767/2002 [Shyam Behari Sharma
Vs. The Jaipur Development Authority] decided on 11.08.2006 wherein the
Division Bench of this court directed the respondent J.D.A. to implement the decision of the Settlement Committee.
It has been submitted by the learned counsel for the petitioner that during the pendency of this writ petition, the Settlement Committee has passed an order dated 08.11.2002 in favour of the petitioner for regularization of the possession of the petitioner.
In view of the above, no direction is required to be given in this writ petition. Learned counsel for the petitioner submits that the respondents are not honouring the decision of the Settlement Committee.
So far as the aforesaid matter is concerned, it is open for the petitioner to approach the J.D.A. for the implementation of the decision as directed by this court vide judgment dated 11.08.2006. The petitioner may submit the representation in this regard and the J.D.A. is expected to decide the said representation within a period of one month from the receipt of the same.
Consequently, the writ petition as well as the stay application stand disposed of, as above.
