The matter has been listed today on an application moved under Section 13(5) of the
Rajasthan Premises (Control of Rent & Eviction)
Act, 1950. However, it is stated at the Bar that the parties have compromised the matter.
Learned counsel for the appellant submits that in compliance of the order passed by the learned trial court dated 12.09.2001, premise has been handed-over to the plaintiff-respondent. He further remains that there remains nothing to be decided in this appeal as the parties have compromised the matter.
In view of above factual position, learned counsel for the appellant seeks permission to withdraw the appeal. Learned counsel for the respondent has no objection to it.
In view of the statement made at the Bar, permission to withdraw the appeal is granted. The appeal stands dismissed as withdrawn.
