HON'BLE MR. JUSTICE DALIP SINGH
Shri Praveen Jain for the petitioner.
Shri R.S. Rathore for the respondent.
Shri B.K. Sharma, Deputy Government Advocate.
The petitioner has filed this writ petition challenging the decision of the respondent for raising construction of Panchayat Bhawan. In response to the notice issued the respondents No. 1 to 4 have filed their reply and have submitted that the petitioner has preferred a revision petition under the provisions of Rajasthan Panchayati
Raj Act, 1994 which is pending consideration.
In view of the above, since the petitioner has already availed the remedy of revision this writ petition is not maintainable and consequently the writ petition stands dismissed. The petitioner would be at liberty to challenge the aforesaid order passed revision in case the petitioner is agreed by means of a writ petition or otherwise as it is submitted that even a suit is pending in the matter before the civil court.
