In this writ petition, the petitioner has prayed for a direction for quashing a demand on account of minimum charges and fuel surcharge.
I am of the view that the aforesaid dispute can be raised by the petitioner before the Settlement Committee appointed for this purpose by the respondent-J.V.V.N.L., which has come in place of the Rajasthan State Electricity Board, as provided by their Lordships of the Hon'ble Supreme Court in the case of
Punjab State Electricity Board and Another Vs. Ashwani Kumar reported in 1997(5) SCC 120.
Learned counsel for the respondents submits that the
Settlement Committee can be approached by the petitioner in the above matter and since the alternative remedy is available to the petitioner, this writ petition may be disposed of with a direction to the petitioner to approach the Settlement
Committee.
In the light of the above, this writ petition is disposed
-:2:- of on the ground that there is alternative remedy available to the petitioner to approach the Settlement Committee.
By the interim order of this court dated 21.01.1992, the disconnection of the electricity supply of the petitioner has been stayed. The said order shall remain in force for a period of two months and the petitioner is free to approach the
Settlement Committee for the redressal of his grievance. The
Settlement Committee is expected to decide the representation/ appeal filed by the petitioner within the aforesaid period of two months.
Consequently, this writ petition as well as the stay application stand disposed of.
