Heard learned counsel for the parties.
The plaintiff-respondents filed a suit for permanent injunction in the lower court, which was decreed and the judgment and decree passed by the lower court has been affirmed by the first appellate court also.
Shri Poonam Chand Bhandari, learned counsel for the defendant-appellant, has argued the case at length and after considering his submissions I am of the view that there is no illegality in the judgment and decree passed by both the courts below so as to interfere in the second appeal under Section 100 of the Code of
Civil Procedure, 1908.
No substantial question of law is involved in this second appeal and the same is dismissed at admission stage itself with no order as to costs.
Consequently, the application dated 7.9.2006 filed by the plaintiff-respondents, is also dismissed.
