While challenging the recovery notice dated 12.4.2005, the petitioner has prayed for payment of grant- in-aid under the provisions of the Rajasthan Non-Government
Educational Institutions (Recognition, Grant-in-Aid and
Service Conditions etc.) Rules 1993.
It is well settled that grant-in-aid cannot be claimed as a matter of right. That apart, even otherwise, in view of specific provisions of Chapter-III, more particularly, Sub-Rules 8, 15 & 17 of Rule 3 and Rules 19 and 21 of the Rules of 1993, the relief, as sought, cannot be granted by this court under writ jurisdiction. The writ petition is dismissed accordingly as having no merits.
