Heard learned counsel for both the parties.
Petitioners have filed the present miscellaneous petition for restoration of S.B. Criminal
Miscellaneous Petition No.495/2004, which has been dismissed because of the peremptory order passed by this court on 25.8.2005. The court allowed two weeks time to learned counsel for the petitioners to do the needful in the matter. The petitioners were required to furnish fresh address of unserved respondents. The counsel submits that the address furnished by him was correct, therefore, the notices are required to be issued to unserved respondents on the same address.
After considering the submissions of learned counsel for both the parties, S.B. Criminal
Miscellaneous Petition No.495/2004 is restored to its original number.
The miscellaneous petition for restoration accordingly stands allowed.
