I have heard learned counsel for the applicant as well as the learned Public Prosecutor for the State assisted by learned counsel for the complainant and carefully gone through the impugned order.
Learned counsel for the applicant submits that he does not want to press the instant bail application, however, prays that proper order may be passed.
Having considered the submission made before me,
I deem it just and proper to issue following directions : 1. The applicant shall surrender himself before the
Investigating Officer/SHO in FIR No.96/06 Police
Station Merta, District Nagaur. 2. The Investigating Officer, upon surrendering the accused applicant, shall produce him before the concerned Court and in case application is moved for bail the concerned Court, shall decide the same on the very same day in accordance with law. 3. In case, the applicant wants to submit representation/documents before the Investigating
Officer, the Investigating Officer shall take the same and make inquiry in relation to it.
The bail application stands dismissed as not pressed.
