CHANDAN SINGH v DESHRAJ AND ORS - CMA Case No. 370 of 2006  RD-RJ 2394 (31 October 2006)
IN THE HIGH COURT OF JUDICATURE FOR RAJASTHAN AT
JAIPUR BENCH JAIPUR
S.B. CIVIL MISC. APPEAL NO.370/2006
CHANDAN SINGH V. DESHRAJ AND ANOTHER
DATE OF ORDER :::::: OCTOBER 31, 2006
HON'BLE MR. JUSTICE PREM SHANKER ASOPA
Mr.L.L.Gupta, for the appellant
This appeal for enhancement of the compensation on account of damage to Jeep No.RJ-20/T-0399 has been filed by the claimant, challenging the Award dated 19.09.2005 passed by the Judge, Motor
Accident Claims Tribunal, Sawai Madhopur in Claim Petition
No.129/2003 whereby compensation amounting to Rs.13,680/- has been awarded.
The facts of the case, in brief, are that the claimant filed a claim petition before the M.A.C.T.
Sawai Madhopur claiming compensation of Rs.60,000/- in relation to damage of his Jeep in an accident which took place on 30.8.2003.
Submission of the learned counsel for the appellant is that claim of Rs.3,700/- has wrongly been denied.
I have heard learned counsel for the appellant and perused the impugned Award and further considered the submission of counsel for the appellant.
The Tribunal after considering the memo of damage Ex.32 found that there is no mention of the damage to the Battery.
In the above facts and circumstances, I am of the view that the compensation awarded by the Tribunal is just, legal and proper and no interference is called for in this appeal.
The appeal is, therefore, dismissed.
