BIRENDRA KUMAR GUPTA v SUDHIR KUMAR - CSA Case No. 448 of 2005  RD-RJ 2445 (2 November 2006)
S.B.CIVIL SECOND APPEAL NO.448/2005
Kishan Lal and another. vs.
DATE OF JUDGMENT ::: 3.1.2006
HON'BLE MR. PRAKASH TATIA, J.
Mr. R Charan, for the appellant.
Heard learned counsel for the appellant.
The suit of the plaintiff was decreed by the trial court vide judgment and decree dated 8.5.1997 on the basis of the admissions of the defendant himself in his statement before the trial court against which the appellants preferred an appeal which was dismissed by the first appellate court vide its judgment and decree dated 8.7.2003.
Since the finding of two courts below on questions of facts is basedon evidence and particularly on the admission of the defendant himself, I do not find that the two courts below have committed any error of fact or law in passing the impugned judgments and decrees.
In view of the above, I do not find any substantial question of law involved in this appeal, therefore, this appeal deserves to be dismissed, hence, dismissed.
(PRAKASH TATIA), J.
