BY THE COURT:

Petitioner is the original loanee. The respondent No.5 is only a surety. If there is a personal transaction between the petitioner and the surety, he may recover the amount from the surety by way of seeking proper remedy before the appropriate forum. In the present case, since, after due consideration, proper discretion has been used by the authority below in passing the impugned order dated 12.9.2006, I find no ground for any further interference of this court. The writ petition is accordingly dismissed as having no merit.
