Heard learned counsel for the applicant and the learned
Public Prosecutor and also perused the material made available to me during arguments.
The applicant was arrested on 17.8.06 and he is in custody since then. Learned PP admits that challan has been filed.
Considering the rival submissions and taking into consideration all the facts and circumstances of the case I deem it just and proper to release the accused applicant on bail under Section 439
It is, therefore, ordered that the accused applicant Durga
Prasad S/o. Mohan Lal in FIR No.129/06 Police Station Kherli, Distt.
Alwar shall be released on bail; provided he furnishes a personal bond in the sum of Rs.50,000/- with two surety bonds of Rs.25,000/- each
(status verified by Tehsildar or any senior Revenue Officer) to the satisfaction of the learned trial court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to do so during the pendency of the trial against him.
