BY THE COURT:

Petitioner is aggrieved by the order dated 12.7.2006 passed by the trial court rejecting the application for impleadment filed on behalf of the petitioner.

After hearing learned counsel for the parties, I have carefully gone through the material on record.

Looking to the nature of controversy involved and rival claims of the parties, in my opinion, the impugned order dated 12.7.2006 cannot be sustained.

Accordingly, the writ petition is allowed. The petitioner is ordered to be impleaded as party-defendant in the suit filed by the plaintiff-respondent. After proper impleadment, the trial court may proceed further in the suit in accordance with law.
