Heard learned counsel for accused petitioner, learned Public
Prosecutor for the State, perused the case diary and other material produced during the course of arguments.
It is alleged that the accused petitioner sold his plot to the complainant and received the amount and thereafter just to defraud the complainant the accused petitioner mortgaged the said plot with the bank and took the loan of about Rs.8,00,000/-.
Without making any observation on merits, having considered the rival submissions made at the bar, nature of accusation and allegations, material on record and all other facts and circumstances, I do not deem it proper to grant the benefit of pre-arrest bail to accused petitioner Smt. Premwati.
The bail application is rejected accordingly.
