The prayer in the writ petition is for payment of the amount of compensation in accordance with the award passed by the respondents along with interest.
In the facts and circumstances, therefore, more particularly in view of the fact that the identical writ petition arising out of the same acquisition being
S.B.Civil Writ Petition No.2108/1996 has already been decided by this court vide order dated 02.06.2004 with direction to make the payment to the petitioner within 30 days of the submission of the certified copy of the order, I deem it just and proper to pass the same order.
Learned Deputy Government Advocate submits that since considerable time has been passed and it is not clear whether the amount has already been deposited in the court or not. The Deputy Government Advocate submits that time allowed by the court under the order dated 02.06.2004 while deciding S.B.Civil Writ Petition
No.2018/1996 in the present case may be enlarged to
-:2:- three months.
Subject to the above, the writ petition is disposed of with a direction that the amount under the award payable to the petitioner be paid within a period of three months. It is further directed that in case the said amount has been deposited by the respondents before the court, the same may be disbursed to the petitioner by the court.
The writ petition as well as the stay application stand disposed of, as above.
