The work under the tender in question has already been awarded, as such, no relief can be granted to the petitioner.
Consequently, the writ petition has become infructuous. However, in case the petitioner is aggrieved at a subsequent stage by the incorporation of the aforesaid condition which is challenged herein, the petitioner would be at liberty to challenge the same.
Subject to the above, this writ petition as well as the stay application stand dismissed as having become infructuous.
