In this writ petition, the petitioner is aggrieved on account of the order dated 12.09.2002 (Annexure-5) passed by the Government exercising the powers under revision under Section 97 of the Rajasthan Panchayati
Raj Act, 1994. The aforesaid order was an interim order pending adjudication of the revision.
Learned counsel for the parties are not in a position to submit as to whether the revision petition has been decided or not. Admittedly, the respondent
Lakhan Singh is not the Sarpanch any more, as such, I deem it just and proper to direct the respondents to decide the revision petition which is pending before the
Government within a period of three months of the receipt of the certified copy of this order. The petition would be at liberty to raise all the objections regarding the maintainability of the revision petition before the revisional authority which shall decide the same in accordance with law.
Consequently, the writ petition as well as the stay application are disposed of, as above.
