UMRAO SINGH MEHTA v RAM SWAROOP 7 ORS - CSA Case No. 643 of 2003  RD-RJ 2692 (14 November 2006)
IN THE HIGH COURT OF JUDICATURE FOR RAJASTHAN
BENCH AT JAIPUR
S.B. Civil Second Appeal No.643/2003
Umrao Singh Mehta S/o late Shri Ranjit Singh Mehta ...plaintiff-appellant
Ram Swaroop S/o Shri Suva Lal & Another ...defendant-respondents
Date of Order ::: 14.11.2006
Hon'ble Mr. Justice Narendra Kumar Jain
Shri Rajendra Prasad, Counsel for plaintiff-appellant
Shri Rajesh Kapoor, Counsel for defendant-respondents ####
By the Court:-
Heard learned counsel for the parties.
The plaintiff-appellant filed a suit for permanent injunction in the lower court, which was decreed. However, on an appeal on behalf of the defendant-respondents, the first appellate court dismissed the suit of the plaintiff-appellant and set- aside the judgment and decree passed by the lower court.
I have heard the learned counsel for both the parties at length and after considering their submissions in the light of the finding of the learned first appellate court I find that no substantial question of law is involved in this second appeal, which calls for any interference of this court under
Section 100 of the Code of Civil Procedure, and the same is accordingly dismissed at admission stage itself with no order as to costs.
