SMT SITA DEVI v BRIJ MOHAN VIJAY - CSA Case No. 130 of 2002  RD-RJ 2921 (24 November 2006)
IN THE HIGH COURT OF JUDICATURE FOR RAJASTHAN
AT JAIPUR BENCH, JAIPUR
S.B. Civil Second Appeal No.130 Of 2002.
Smt. Sita Devi Vs. Brij Mohan Vijay
Date Of Order ::: 24.11.2006.
Hon'ble Mr. Narendra Kumar Jain J.
Mr. J.P. Goyal, Counsel for defendant-appellant
Mr. Vishnukant Sharma, on behalf of
Mr. A.K. Sharma, Counsel for plaintiff-respondent
By the Court :
Heard learned counsel for both the parties.
The plaintiff-respondent filed a suit for eviction in respect of the rented property, which was dismissed by the Lower Court on the ground of personal bona-fide necessity. The judgment and decree passed by the Lower Court has been affirmed by the First
Appellate Court also.
I have heard the learned counsel for both the parties and after considering their submissions in the light of the finding of both the Courts below, I do not find any substantial questions of law involved in this second appeal and the same is accordingly dismissed at the admission stage itself with no order as to costs.
(Narendra Kumar Jain) J.
