Heard learned counsel for the plaintiff- appellants on the application under Section 5 of the
Limitation Act as well as on the merits of the second appeal.
The plaintiff-appellants filed a suit for eviction in respect of the rented property in the Lower
Court on the ground of personal bona-fide necessity, which was dismissed. The judgment and decree passed by the Lower Court has been affirmed by the First
Appellate Court also.
I have heard learned counsel for the plaintiff-appellants and after considering his submissions, I do not find any substantial questions of law involved in this second appeal.
The appeal is barred by 21 days and I am not satisfied with the reasons given in the application under Section 5 of the Limitation Act for condonation of delay. The application under Section 5 of the
Limitation Act is accordingly dismissed.
No substantial question of law is involved in this second appeal.
Consequently, the second appeal is dismissed being barred by limitation as well as on merits also.
