RATAN LAL GARG v SHEELA KUMARI - CSA Case No. 01367 of 2002  RD-RJ 3011 (29 November 2006)
IN THE HIGH COURT OF JUDICATURE FOR RAJASTHAN
AT JAIPUR BENCH, JAIPUR
S.B. Civil Second Appeal No.01367 of 2002.
Ratan Lal Garg & Others Vs. Smt. Sheela Kumari
Date of Order ::: 29/11/2006
Hon'ble Mr. Narendra Kumar Jain, J.
Mr. Rajesh Kapoor, Counsel for plaintiff-appellants.
By the Court :
Heard learned counsel for the plaintiff- appellants on the application under Section 5 of the
Limitation Act for condonation of delay of seven days as well as on the admission of the second appeal.
The plaintiff-appellants filed a suit for possession in respect of the disputed property, which was dismissed by the Lower Court. The judgment and decree passed by the Lower Court has been affirmed by the First Appellate Court also.
I have heard learned counsel for the plaintiff-appellants and after considering his submissions in the light of finding of both the Courts below, I do not find any substantial questions of law involved in this second appeal.
The reasons given in the application for condonation of delay are also not satisfactory. The application under Section 5 of the Limitation Act is accordingly dismissed.
No substantial question of law is involved in this second appeal.
Consequently, the second appeal is dismissed being barred by limitation as well as on merits also.
