HAR NAND SINGH v HUKMA RAM & ORS - CSA Case No. 444 of 1998  RD-RJ 3049 (1 December 2006)
IN THE HIGH COURT OF JUDICATURE FOR RAJASTHAN
AT JAIPUR BENCH, JAIPUR
S.B. Civil Second Appeal No.444 of 1998.
Harnand Singh Vs. Hukma Ram & Others.
Date of Order ::: 01/12/2006
Hon'ble Mr. Narendra Kumar Jain, J.
Mr. B.L. Mandhana, Counsel for defendant-appellant.
Mr. D.V. Tholia, Counsel for plaintiff-respondents
By the Court :
Heard learned counsel for both the parties.
The plaintiff-respondents filed a suit for declaration and permanent injunction and injunction in mandatory form also. The suit of the plaintiff was decreed by the Lower Court. However, on an appeal filed by the defendants the First Appellate Court partly allowed the appeal and modified the decree of the Lower
Court. Being aggrieved with the same the defendant No.1 has filed this second appeal.
I have heard learned counsel for both the parties and after considering their submissions in the light of the finding of the First Appellate Court, I do not find any substantial questions of law involved in this second appeal and the same is accordingly dismissed at the admission stage itself with no order as to costs.
