CHAND KAUR & ORS v ROHIDAS & ORS - CMA Case No. 293 of 2006 RD-RJ 305 (6 March 2006)
S.B. CIVIL MISC. APPEAL NO. 293/2006
Date : 06.03.2006
HON'BLE MR. BHAGWATI PRASAD.J.
Mr. Sanjay Poonia for the appellant
The present appeal is filed for enhancement of the award. The deceased was allegedly 40 years of age in postmortem report. However, the
Tribunal has considered the age to be 33 years and while considering the income of the deceased, came to the conclusion that he was earning Rs.2400/- per month as against the certificate of Rs.2220/-. Thus, a legitimate consideration of the monthly income has been taken by the Tribunal. In that background, if a multiplier of 16 has been used, that is not considered to be in- appropriate. The award does not suffer from any illegality. The appeal having no force is hereby dismissed.
