This writ petition has been preferred by the petitioner seeking writ, order or direction directing the respondents to provide selection scale on completion of 9, 18 and 27 years of service.
It is submitted on behalf of the petitioner that during pendency of the writ petition, the benefit of selection scales after completion of 9 and 18 years of service has been given to the petitioner and only controversy remains that the benefit of selection scale after completing 27 years of service has not been provided to the petitioner.
It is given out by the respondents in their reply that several enquiries are pending against the petitioner.
During pendency of the writ petition, the petitioner died and the legal representatives of the petitioners have been taken on record and it is further contended by the learned counsel for the petitioner that neither any enquiry has been initiated against the petitioner nor any charge-sheet has been issued and his application for voluntary retirement has been accepted and retiral benefits are also given and now the only controversy remains to the extent of providing benefit of selection scale after completing 27 years of service.
It is expected from the respondents to consider the case of the petitioner and if nothing found against the petitioner during his service time and no enquiry and punishment has been awarded, in such case, the benefit of selection scale after completion of 27 years of service be provided to the petitioner and the difference of that amount be also paid to the petitioner and accordingly retiral benefits be also revised.
With these observations, the writ petition stands disposed of.
