M/S NIHCHAL DAS RAMCHANDRA THR v DARGAH COMMITTEE AJMER - CSA Case No. 475 of 2006  RD-RJ 3069 (4 December 2006)
IN THE HIGH COURT OF JUDICATURE FOR RAJASTHAN
BENCH AT JAIPUR
S.B. Civil Second Appeal No.475/2006
M/s Nihalchand Ramchandra through Shri Hotchand (deceased) through L.Rs.
Smt. Kalawati & Others ...defendant-appellants
Dargah Committee, Ajmer ...plaintiff-respondent
Date of Order ::: 04.12.2006
Hon'ble Mr. Justice Narendra Kumar Jain
Shri Ashok Kumar Shahdadpuri, Counsel for appellants
Shri J.C. Jain, Counsel for respondent ####
By the Court:-
Heard learned counsel for the parties.
The second appeal was listed on 27.11.2006 and after arguing the case for quite some long time, the learned counsel for the appellants prayed for grant of some time to seek instructions in the matter from the appellants to grant time to vacate the premises.
The appellant no.4 Shri Laxman is present in person along-with his counsel. The learned counsel submits that he may again be heard on merits of the case and he does not want time to vacate the premises.
In these circumstances I have again heard the matter.
The plaintiff-respondent filed a suit for eviction, which has been decreed by both the courts below. After considering the submissions of learned counsel for both the parties in the light of findings of both the courts below, I do not find any substantial question of law involved in this second appeal under Section 100 of the C.P.C.
The second appeal is accordingly dismissed at admission stage itself with no order as to costs.
