Heard learned counsel for both the parties.

Learned counsel for the applicant has filed this application under Section 151 of the C.P.C., for staying the operation of the order dated 15.11.2006 passed by the Executing Court in Execution Application

No.12/2006. The second appeal bearing No.333/1999 filed by the applicant-appellant was dismissed by this Court as not pressed while granting time to vacate rented premises on certain terms and conditions vide order dated 07.04.2006. The appellant failed to comply with the terms and conditions, as mentioned in the order dated 07.04.2006, therefore, the Executing Court passed the impugned order. I do not find any illegality in the order passed by the learned Lower Court.

There is no merit in this application and the same is accordingly dismissed.
