Instant revision petition has been filed by the defendant-petitioner against the judgment and decree of the learned Appellate Court dated 17th September, 2004 whereby while accepting the appeal, the judgment and decree dated 23rd November, 2000 was set aside.

During the course of argument, counsel for non- petitioner-plaintiff as per telephonic instructions received by him, informed this court that payment has already been made in terms of judgment and decree of the learned Appellate Court which is impugned in the present revision petition.

In view of statement which has been recorded supra, counsel for petitioner submits that if that be so, the revision petition has become infructuous.

The same is, accordingly, dismissed as having become infructuous. [AJAY RASTOGI],J.
