Mr.SK Singodia, for the petitioners.

Petitioners have challenged the order dated 16/09/2003 passed by the respondent Labour Department refusing to refer the dispute in regard to termination of services of the petitioners for adjudication on the ground that the concerned workmen not having completed 240 days and further dispute also having been raised after 11 years.

After having carefully gone through the material on record, since no explanation whatsoever has been given for raising the dispute after such a considerable delay, looking to the nature and duration of employment, in the facts and circumstances, I find no ground for any interference of this Court in the discretion used by the respondents.

The writ petition is dismissed accordingly as having no merits.
