Learned counsel for the appellant states that he has moved an application before the
Collector, 'officer on special duty' for allotment of acquired land after development to the petitioner. On which application, the respondents have agreed to allot the appellant 15% of the acquired land out of the developed land. These facts are not disputed by learned counsel for the respondents.
On the aforesaid prayer having been granted by the respondents, the appellant does not want to continue with this litigation relating to withdrawal of acquisition proceedings under Section 48 of the Land Acquisition Act.
Accordingly, the appeal is dismissed with no orders as to costs. [ R.P. VYAS ], J. [ RAJESH BALIA ], J. babulal/
