Addl.District Judge, Rajsamand in Civil Appeal No.71/1981.

BY THE COURT:

An application has been filed by the parties wherein the plaintiff of the suit no.16/80 sought permission to withdraw the suit as the matter has been settled between the parties and the photo-stat copy of the compromise has been placed on record along with the application presented in court on 12.4.2006.

In view of the above, Civil Original Suit No.16/1980 is dismissed as withdrawn and consequently, the decree passed by the first appellate court daed 7.3.1987 is set aside because the plaintiff has withdrawn the suit.

Consequently, the appeal has become infructuous. Hence the appeal is dismissed.
