This appeal is directed against the order of learned Single Judge partially accepting the prayer of the appellant-petitioner for grant of interim relief. However, he is aggrieved of not acceding to the request of staying the forfeiture of security and certain demand raised on account of having forced to take resort to fresh proceedings for grant of contract de novo for which the appellant has earlier given highest bidder and was accepted, but according to the respondent he has not responded in time to complete the finalisation of contract and delayed the implementation of work.
In the circumstances, we are of the opinion that no case is made out for interference in the decision rendered on the application for interim relief. Whatever interim relief is granted or not granted is subject to final outcome of the writ petition which is pending before the learned Single Judge.
Therefore, we refrain from commenting on the merit of the petitioner's case.
