The matter comes up for not filing of P.F. & notices for respondent no.1. However, Mr. Mehta appears for respondent no. 2. Learned counsel for the parties submit that the respondent no. 1 being formaly party, it's service be dispensed with.
Vide order dt. 24.11.2005 show cause notice had been issued, on the statement of the learned counsel for the petitioner, that he will make sincere efforts to settle the matter amicably between the parties. Today both the learned counsel submit, that they are agreeable, to the effect, that the petitioner will reinstate the workman respondent no.2, and the learned counsel for the workman agrees, that the workman fore goes the back wages.
Accordingly, at the request of the learned counsel for the parties the writ petition is disposed of by modifying the impugned award, in view of the above concession, that the workman shall be reinstated without back wages. This be done within six weeks. It is also agreed, that in the event of workman being not reinstated within six weeks, the writ petition will stand dismissed whole hog, without there being any modification in the award.
