BHOLA RAM v SURJEET SINGH & ORS. - CMA Case No. 727 of 2007  RD-RJ 1008 (22 February 2007)
S.B. CIVIL MISC. APPEAL NO.727/2007
(Bhola Ram Vs. Surjeet Singh & ors.)
Date of Order :: 22nd February 2007
HON'BLE MR. JUSTICE DINESH MAHESHWARI
Mr.N.S.Khileri for the appellants ...
For accidental death of 4 years old child Prema
Ram, the Tribunal has awarded compensation in the sum of
Rs.1,72,000/- to the father of the victim while taking notional income of the deceased at Rs.15,000/- per annum and with application of multiplier of 17 after deducting one-third on personal expenditure. The claimant seeks enhancement by way of this appeal.
The ultimate amount awarded by the Tribunal cannot be said to be too low or inadequate than that of just compensation admissible in the fact situation of this case; and there appears no scope for interference in appeal at the instance of the claimant, father of the deceased.
The appeal fails and is, therefore, dismissed summarily.
